Day-1 CPT Strategy: Legally Work in the US for Up to 8 Years
Many international students dream of studying and working in the United States. Usually, they follow a common path: complete a bachelor’s or master’s degree, apply for Optional Practical Training (OPT) to get work experience, and then hope to get an H-1B visa sponsored by their employer during the OPT period. This path includes finishing your studies, gaining work experience, and moving into your professional career.
However, getting an H-1B visa is absolutely not easy and not controllable. The H-1B visa lottery offers 85,000 spots each year, which is far fewer than the number of people who apply for it. The chart below, from USCIS, shows how the number of people entering the H-1B lottery has been increasing each year. Starting in FY 2023, the number of applicants grew even more due to more students coming after the pandemic and issues with H-1B abuse. Even though there were changes in FY 2025 to reduce the H-1B abuse, the number of applicants is still high, and only about 20% of them get selected in the lottery.

As international students in the U.S. pursuing our dreams, we are not going to just sit and do nothing. Faced with various challenges, we always find effective ways to overcome them! Today, let’s focus on introducing a strategy that is applicable to the vast majority of international students in the U.S. who are facing the status dilemma: Day-1 CPT. We’ll delve into the journey of Day-1 CPT and explore how long it can extend your stay in the U.S.
A Quick Overview of Day-1 CPT
💡Pro Tip: Day-1 CPT does not directly increase your H-1B lottery odds. It may give you additional time to stay in a valid F-1 status, work through CPT, and continue applying for H-1B in future cycles.
If your OPT is about to expire and your chances for an H-1B visa are running out, you can apply for and switch to a Day-1 CPT program before your status expires (while you are still within your Grace Period). This allows you to continue studying as an F1 student while working using CPT to keep participating in the H-1B lottery.
If your status has already expired, the process becomes more complicated. But don’t worry, you can still apply to a Day-1 CPT school as usual. Once you receive your acceptance letter and Initial I-20, you can choose to activate your status by re-entering the country or completing the Change of Status (COS) process within the US. Then, you can start your studies and work, continuing to participate in the H-1B lottery!

How a Long-Term Day-1 CPT Pathway May Work?
A long-term Day-1 CPT strategy usually does not start with Day-1 CPT.
For most students, the more common path is:
- Complete a bachelor’s or master’s degree in the U.S.
- Use OPT or STEM OPT to work legally after graduation
- Apply for the H-1B lottery through an employer
- If not selected before OPT ends, consider Day-1 CPT as a backup option
This matters because Day-1 CPT should usually be part of a broader immigration and career plan, not a last-minute reaction.
Stage 1: Use OPT or STEM OPT First After Graduation
After completing the undergraduate or graduate degrees, eligible graduates can apply for Optional Practical Training (OPT) within a specified timeframe. You can legally start working once you receive your Employment Authorization Document (EAD) card. During your employment, as long as the employer offers the H-1B sponsorship, you can submit an H-1B visa application once per year to participate in the lottery.
| Student Background | OPT Timeline | H-1B Lottery Attempts During OPT | Key Notes |
|---|---|---|---|
| Undergraduate, non-STEM | Usually 1 year | Usually 1 | No STEM OPT extension |
| Undergraduate, STEM | Up to 3 years | Up to 3 | May qualify for 24-month STEM OPT extension |
| Graduate, non-STEM | Usually 1 year | Usually 1 | May qualify for H-1B Master’s Cap if school/program meets requirements |
| Graduate, STEM | Up to 3 years | Up to 3 | May qualify for both STEM OPT extension and Master’s Cap |
Undergraduate Students (Non-STEM):
Non-STEM undergraduate students have a one-year OPT period with only one chance to participate in the H-1B lottery during OPT.
Undergraduate Students (STEM):
STEM undergraduate students can apply for an additional two-year OPT extension beyond the initial one-year OPT period. This allows them to have a total of three years of OPT and three chances to participate in the H-1B lottery.

Graduate Students (Non-STEM):
Non-STEM graduate degree holders have a one-year OPT period with one chance to participate in the H-1B lottery. Compared to undergraduate students, graduate students with specific qualifications have an advantage in the H-1B lottery. They can apply for the additional 20,000 special slots under the H-1B Master Cap.
Graduate Students (STEM):
After completing the initial one-year OPT period, they can apply for a STEM OPT extension. This extension grants them an additional 24 months of work authorization, totaling three years of OPT. With this extended period, they have more opportunities for work and can participate in the H-1B lottery three times.

Stage 2: Choose a Career-Aligned Day-1 CPT Graduate Program
After using OPT or STEM OPT, while not selected from H-1B, some students may consider a Day-1 CPT graduate program as the next step.
This stage is often the first Day-1 CPT stage in a long-term plan. The key is to choose a program that is not only available for CPT, but also makes sense for your academic background and current job.
Day-1 CPT Program Selection Principles: If you are planning to work using CPT during your Day-1 CPT program, make sure to choose a Day-1 CPT program that has at least some aspects of the program that are relevant to your work.
> If Your Highest Degree Is a Bachelor’s Degree
If your highest degree is a bachelor’s degree, you usually have more flexibility when choosing a Day-1 CPT graduate program.
You can choose a program that fits your career goals, but you should still consider three important factors:
Full-Time CPT and Future OPT Eligibility
If you have not used OPT after your bachelor’s degree and you plan to use OPT after your graduate program, be careful with full-time CPT. Using full-time CPT for 12 months or more may make you ineligible for OPT at the same degree level
To reduce this risk, some students may consider:
– Choosing a shorter program (e.g. 12 months)
– Keeping full-time CPT under 12 months
– Switching to part-time CPT if possible
– Taking unpaid leave if neededThis should be planned carefully with your school’s DSO or academic advisor.

2. STEM Program Options
Consider choosing a STEM-certified graduate program that offers the chance to apply for an extra 24-month OPT extension after the initial one-year OPT.
3. Nonprofit School and H-1B Master’s Cap
Selecting a nonprofit school allows participation in the H-1B Master Cap lottery.
> If You Already Have a Graduate Degree
If your highest degree obtained previously is a graduate degree, and you’ve already used the OPT opportunity during that program, you have more flexibility in using full-time CPT during your Day-1 CPT program without the one-year limitation.
1. A second graduate program may be more reasonable if it clearly supports a new or deeper career direction.
For example:
– Moving from business to data analytics
– Moving from general management to information systems
– Moving from non-technical work into technology or analytics
– Building specialized skills that your previous degree did not cover
The key is to show a logical academic progression.
2. If your previous graduate degree’s school does not qualify for the H-1B Master Cap lottery, choosing a nonprofit school for your Day-1 CPT program can make you eligible for the H-1B Master Cap lottery after graduation.

Stage 3: Consider an MBA Only If It Fits Your Career Path (1.5-2.5 Years)
Pursuing an MBA is highly applicable to many career paths. Most jobs incorporate some of the knowledge and skills taught in MBA programs. Nowadays, many MBA programs offer concentrations that allow you to tailor your education to your career interests.
For Students Without an MBA:
You can choose an MBA program based on various factors, such as program structure, location, on-campus requirements, CPT policies, and tuition fees. Select the program that best fits your needs and your current situation to apply.
For Students Who Have Already Completed an MBA:
If you already have an MBA, you can skip this stage. However, if you want to maximize your stay, you can opt for a different concentration. Make sure to compare the curriculum of the new program with your existing degree and choose a program that offers distinct courses.

Stage 4: Consider a Doctoral Program for Long-Term Planning (3-5 Years)
After completing one or more graduate-level programs, some students may consider a doctoral Day-1 CPT program as the final stage of a long-term academic and immigration strategy.
Doctoral programs usually require a longer commitment than master’s programs, but they may provide a more logical next step for students who already hold multiple graduate degrees or want to advance into leadership, research, or senior technical roles.
DBA Programs:
These typically take 3-5 years to complete and offer flexibility to adjust the duration based on your progress. Like an MBA, a DBA is applicable for many careers.
DIT Programs:
Suitable for students with a background in science and technology who want to continue working in related fields.
Several schools in the US offer doctoral programs with Day-1 CPT doctoral programs. Some of the Day-1 CPT universities providing these programs are listed below👇.

From the information above, a long-term Day-1 CPT pathway may help students extend their legal study-and-work timeline in the U.S. for several additional years.
A possible pathway may look like this:
Stage 1: A career-aligned graduate Day-1 CPT program
Stage 2: An MBA or another distinct graduate program, if it fits your academic path
Stage 3: A doctoral program such as a DBA or DIT
This is where the “up to 8 years” idea usually comes from:
– First graduate-level Day-1 CPT program: around 1–3 years
– MBA or second graduate program: around 1.5–2.5 years
– Doctoral program: around 3–5 years
